法商融合标准体系构建研究

摘要：

【目的】为促进贸易便利化，降低商事活动合规、争议防范与解决综合成本，提升商事主体与商事法律服务机构协作能力，提出一套以法商融合为思路的整合型标准体系。【方法】界定了法商融合标准化的范围，基于需求侧和供给侧的数据分析，识别了法商融合标准化需求。【结果】研究发现，现有标准虽分别覆盖合规、风险与解纷环节，但在经贸场景整合落地方面仍存在缺口。基于此，提出以“基础通用—商事活动运行融合—商事法律服务融合—场景应用—服务支撑”为主线的法商融合标准体系框架，并论证各模块的功能定位、层级关系与实施路径。【结论】法商融合标准体系是增强企业出海规则适应能力的重要抓手，是法治化营商环境建设的公共服务工具。

Abstract:

[Objective] This paper aims to propose an integrated standards system based on the concept of law-business integration. By implementing this standards system, trade facilitation can be promoted, and overall costs across compliance, dispute prevention, and resolution in trade can be reduced. [Methods] This study defines the scope of standardization for law-business integration. Based on the analysis of both the demand and supply sides, it identifies the critical area of law-business integration standardization. [Results] The findings indicate that although existing standards separately cover compliance, risk management, and dispute resolution, gaps remain in their application in trade scenarios. In response, this paper proposes a law-business integration standards system framework structured around five modules. [Conclusion] The proposed framework can enhance rule-adaptation capacity for outbound enterprises, offering a practical tool for advancing a rules-based business environment.
