创新驱动背景下知识产权标准体系建设及标准需求分析

摘要：

【目的】搭建知识产权标准体系框架，明确知识产权标准制定需求，为知识产权标准体系优化、标准精准研制与实施提供理论支撑，助力知识产权事业高质量发展。【方法】基于系统工程学原理搭建知识产权标准体系框架；运用德尔菲法构建评价指标层次模型，并采用层次分析法、变异系数法、信息熵权法及组合赋权法，对标准制定需求进行量化分析，计算各层次、各领域需求权重。【结果】各领域标准需求差异显著，技术创新、市场运营需求旺盛，社会公共利益领域需求相对较弱。技术创新领域标准需求内部不均衡，新兴领域标准需求处于较低水平，专利导航与产业协同领域标准需求最为突出。【结论】需求差异由多重因素决定，应优先补齐专利导航领域短板、填补传统领域空白、动态跟进新兴领域建设并加强标准宣推，精准完善知识产权标准体系。

Abstract:

[Objective] The study aims to construct a framework for the intellectual property rights(IPR) standards system, clarify the demands for formulating IPR standards, provide theoretical support for the optimization of the IPR standards system and the precise development and implementation of standards, and boost the high-quality development of the IPR cause. [Methods] The IPR standards system framework was constructed based on the principles of systems engineering. The analytic hierarchy model of evaluation indicators was built using the Delphi method, and the analytic hierarchy process, coefficient of variation method, information entropy weight method and combined weighting method were adopted to conduct a quantitative analysis of the demands for formulating IPR standards and calculate the demand weights of each level and field. [Results] Standard demands vary significantly across different fields, with strong needs in technological innovation and market operations, while demands in areas related to public social interests are relatively weak. Within the technological innovation sector, standard demands are unevenly distributed, with emerging fields showing lower demand levels, and patent navigation and industrial collaboration standing out as the most prominent needs.[Conclusion] The differences in demands are determined by multiple factors such as interest demands, participants, implementation scenarios and collaboration difficulty. It is necessary to prioritize filling the standard gaps in the patent navigation field, addressing the blank in traditional fields, dynamically following up the construction of standards in emerging fields and strengthening the promotion of standards, so as to improve the IPR standards system in a targeted manner.
