WTO/TBT协定下的我国技术法规：概念接受、认知与实践

摘要：

【目的】厘清WTO/TBT协定中技术法规概念在我国的接受过程与实践形态。【方法】通过梳理我国入世法律文件、标准化政策与TBT通报实践，分析该概念从国内法消退到依国际条约复归的演进路径。【结果】我国经由WTO承诺接受TBT协定的技术法规概念，其核心对应我国法律与标准化实践中的强制性标准及其他具有强制效力的技术规范，并在通报实践中体现为多元形式。【结论】技术法规在我国已成为兼具国际法依据与国内实践支撑的法律概念，其关键在于法律赋予的强制性，反映了法律体系与标准化体系的制度衔接。

Abstract:

[Objective] The study aims to clarify the acceptance process and practical form of the concept of technical regulations in the WTO/TBT Agreement in China. [Methods] By reviewing the legal documents, standardization policies, and TBT notification practices of China’s accession to the WTO, the paper analyzes the evolution path of this concept from fading from domestic law to returning to international treaties. [Results] China has accepted the concept of technical regulations in the TBT Agreement through WTO commitments, which corresponds to mandatory standards and other technical specifications with mandatory effect in the pratice of standardization and law in China, and is reflected in multiple forms in notification practice. [Conclusion] Technical regulations have become a legal concept in China that combines an international legal basis and domestic practice support. Its key lies in the mandatory nature conferred by the law, reflecting the institutional connection between the legal system and the standardization system.
