法规引用标准的理论阐释、运行机制与制度展望

摘要：

【目的】随着技术治理需求的提升，国际上普遍通过引用标准支撑法律、行政法规等规范性文件的技术内容，以实现规则协调并提高治理效率。【方法】通过文本分析与制度比较相结合的方法，系统分析了法规引用标准的内涵及其价值，阐述了法规引用标准时的总体考虑和原则，并详细介绍了法规引用标准的方式。【结果】法规引用标准前需总体考虑对拟引用标准的评价、引用标准效力以及引用标准类别和合作机制。在引用方式上，法规引用标准主要包括直接引用和间接引用2种基本方式。并围绕当前我国法规引用标准机制建设存在的不足，从立法事前、事中、事后3个阶段，提出了对法规引用标准实践的系统思考和展望。【结论】为我国法规引用标准的实践操作和法规引用标准活动的规范化和机制化发展提供技术和路径参考。

Abstract:

[Objective] With the increasing demand for technology-based governance, citing standards in regulations has become a widely adopted approach internationally to support the technical content of laws, administrative regulations, and other normative documents, aiming to coordinate rules and enhance governance efficiency. [Methods] This paper applies textual and comparative institutional analysis to systematically examine the connotation and value of standards cited in regulations, clarify the general considerations and principles, and describe the main modes of these standards. [Results] The study indicates that prior to citing standards, regulators should consider the evaluation of proposed standards, the determination of their legal effect, the selection of appropriate standard types, and cooperative mechanisms; the citation mainly involves direct and indirect approaches. In light of existing deficiencies in China’s institutional framework, the paper presents systematic analysis and an outlook on regulatory citation practices across the ex ante, in-process, and ex post stages of legislation. [Conclusion] The paper provides technical guidance and strategic reference for the practical implementation of citing standards in regulations, as well as for the standardized and institutionalized development of regulatory citation practices in China.
