摘要:
【目的】在数字化转型与全球规制环境日益复杂的背景下,厘清标准与制度的动态关系对提升治理效能至关重要。因此从空间动力学视角,探讨标准在制度谱系中的定位及其对实体行为的驱动机制。【方法】构建一个包含经济、社会、政治3个维度的“规制空间动力学模型”,通过界定非正式文化惯例、契约与标准、法律规制3个位阶,建立环境应力与实体内生应力对冲的应力矩阵。重点解析对冲稳态、协同演化、位阶跃迁和位阶俘获等动力学特征,并利用矢量合成逻辑模拟了实体在不同场域下的演化轨迹。【结果】标准主要在制度谱系的中观位阶发挥作用,通过与实体内生动力的耦合,可产生正向牵引力,驱动实体实现合规性优良演化。模型揭示了法律位阶的全维度分布特征,即任何轴向的严重违规均会触发整体位态的向心收缩。数字化的集成标准由于具备“流程硬化”与“算法锁定”特征,已演化为制度规制的刚性约束。【结论】研究的创新之处在于将社会治理逻辑转化为规制场论表述,明确了标准在制度谱系中作为动力牵引的核心功能,为精准规制与企业战略对齐提供形式化的分析工具。
Abstract:
[Objective] Against the backdrop of digital transformation and an increasingly complex global regulatory environment, clarifying the dynamic relationship between standards and institutions is crucial for enhancing governance effectiveness. Accordingly, from a spatial dynamics perspective, this study explores the positioning of standards in the institutional pedigree and their driving mechanisms on entity behavior. [Methods] A “regulatory space dynamics model” encompassing three dimensions (economic, social, and political) is constructed. By defining three hierarchical levels—informal cultural practices, contracts and standards, and legal regulation—a stress matrix for offsetting environmental stress and entity endogenous stress is established. The analysis focuses on dynamic characteristics such as stress equilibrium, co-evolution, hierarchical transition, and hierarchical capture, and uses vector composition logic to simulate the evolutionary trajectories of entities in different fields. [Results] The study finds that standards primarily function at the meso-level of the institutional pedigree. Through coupling with entity endogenous dynamics, they generate positive traction, driving entities to achieve compliant and optimal evolution. The model reveals the full-dimensional distribution characteristics of the legal hierarchy: any fatal violation along any axis triggers a centripetal contraction of the overall position state. Due to their features of “process hardening” and “algorithmic locking”, digital integrated standards have evolved into rigid constraints of institutional regulation. [Conclusion] The innovation of this study lies in transforming social governance logic into a regulatory field theory representation, and clarifying the core function of standards as dynamic traction in the institutional pedigree, thereby providing a formal analytical tool for precision regulation and corporate strategic alignment.
